Meylex Pty Ltd, is  a company registered at Suite 31/112, McEvoy Street, ​Alexandria NSW 2015. ABN 48 492 044 342 and trading as MyPortalInsure (Meylex).

 By accessing the Website you agree to comply with and be bound by the Terms. If you do not agree with any part of the Terms you must not use the Website.

Definitions

  • “Website”, “MyPortal.Insure”, and “Myportal” refers to the Myportal.insure website located at [Website URL].
  • “Company”,”We”, “Us”, “Our” refers to Meylex.
  • “Terms” means these terms and conditions and the terms and conditions governing the use of the Website.
  • “You”, “User”, “users”, “Users”, “customer” refers to any individual or entity using our Website.

 Website.

We operate the Website . The Website is an embedded insurance platform that may be white labelled by an Insurer or Broker or used as an embedded insurance system. 

  • As an insurance platform, Myportal operates embedded into the website of an Insurer or Broker, to provide all the functionality needed to run an insurance business.
  • As an embedded insurance platform MyPortal.Insure, seamlessly integrates into the purchase process of another product or service,, which means that when you buy something like a flight ticket, a car, or even an electronic device, you can add insurance coverage at the same time, without needing to go through a separate process.

By accessing and/or using the Website, you agree to the Terms and to our Privacy Policy available at http://myportal.insure/policy . You should review the Terms, and immediately cease using our website if you do not agree to the Terms.

The Website is software that provides a tool for insurers, brokers, their customers and ancillary service providers. The Website provides a digital process for creating insurance quotes and policies, and for managing the lifecycle of these policies, from creation to expiry of the policy. The Website stores all information relating to the insured person/s that is required for the purpose of maintaining the insurance policy.

The Website and the Company take no responsibility for the information entered into the Website by the users of the Website or the use of this information. This information is entered into by the users and is confirmed and saved at the sole discretion of the users. The person/s and users entering this information is responsible for the content of the information that has been entered.

1. Registration

Users of the Website will need to first register on the Website to access the Website and access all the features of the Website.

In order to register,  users will need to provide personal and company information including full name; mobile number, email address, company ABN, and Australian Financial License number (AFSL).

All personal and business information that is collected, will be handled  in accordance with our Privacy Policy http://myportal.insure/privacy.

After users have completed their registration, and activated their account, they will be provided with a username and password. Users are responsible for keeping these credentials secure and are responsible for all use and activity carried out using these credentials on the Website.

The requirements to become a registered user:

  •   Be at least 18 years of age;
  •   Possess the legal rights as requested for each user type and ability to enter into a legally binding agreement with us; and
  •   Agree and warrant to use the Website in accordance with the Terms.

2. Collection Note

We collect personal information about users in order to respond to enquiries, process registrations, and provide all the features of the Website and for purposes otherwise set out in our Privacy Policy at http://myportal.insure/privacy.

We may disclose that information to third parties that help us deliver our services (including information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all of our services and products to you. We may also disclose your personal information to recipients that are located outside of Australia, including to our development team located in Vietnam. We do not disclose banking or payment information.

Our Privacy Policy explains: (i) how we protect, store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint. 3. Accuracy, completeness and timeliness of information

The information on the Website is not comprehensive and is intended to provide a summary of the subject matter covered. While we use all reasonable attempts to ensure the accuracy and completeness of the information on the Website, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on this Website. You should monitor any changes to the information contained on the Website.

We are not liable to you or anyone else if interference with or damage to your computer systems occurs in connection with the use of the Website. You must take your own precautions to ensure that whatever you select for your use from the Website is free of viruses or any other harmful software that may interfere with or damage the operations of your computer systems and your data.

We may, from time to time and without notice, change or add to the Website including the Terms or the information, products or services described in it. However, we do not undertake to keep the Website updated. We are not liable to you or anyone else if errors occur in the information on the website or if that information is not up-to-date.

The Website provides calculated financial amounts that are used for processing of insurance policies. We use best endeavours to achieve correctness in these calculations, and we do not guarantee such calculations will suit all users. Users will need to familiarise themselves with these calculations through prior demonstrations of the Website before agreeing to use these calculations and the Website for their business. We are not responsible for financial loss caused to the user or their business by the calculations used by the Website.

4. Promotions

For certain campaigns and promotions, additional terms and conditions may apply. If you want to participate in such a campaign or promotion, you need to agree to the relevant terms and conditions applicable to that campaign or promotion. In case of any inconsistency between such terms and conditions and the Terms, those terms and conditions will prevail.

5. Purchases

5.1. How an individual may buy a product or service

The Website receives payment for the services provided. The Website is licensed to you to use the software for the purpose of creating and managing insurance quotes and insurance policies. Users will only be charged for creating an insurance quote and/or policy, when policy is completed and paid by the customer to the insurer.

 

5.2 Pricing policy

The Website is priced on a pay per use basis. Refer to pricing schedule at registration for further details. Prices may change at any time without notice.

5.3 Payment methods and security

Payments are accepted by Paypal, Mastercard and VISA card, and by direct debit.

5.4 Cancellation of payments

The Website offers cancellation of insurance policies within 14 days of acceptance of the policy. 

6. Termination

We may terminate use of the Website at any time without giving notice to you. Unless we tell you otherwise, upon termination, (a) the license granted to you in the Terms will end; (b) and you must cease from using the Website immediately, and if needed delete it from your device

7. Sharing of information

The Website provides a platform for insurance quotes and policies to be generated, maintained and managed. We do require all users to identify themselves before using the Website, information and other information that is published on the Website, will not be viewed or used by parties other than those registered on the Website.

We also do not warrant that this information that you provide is not used in a detrimental way to you or your business.

8. Linked sites

The Website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.

9. Intellectual property rights

Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in the Website and in all of the material (including all text, graphics, logos, audio and software) made available on the Website (Content).

Your use of the Website and use of and access to any Content does not grant or transfer any rights, title or interest to you in relation to the Website or the Content. However we do grant you a licence to access the Website and view the Content on the Terms  and, where applicable, as expressly authorised by us and/or our third party licensors.

Any reproduction or redistribution of the Website or the Content is prohibited and may result in civil and criminal penalties. In addition, you must not copy the Content to any other server, location or support for publication, reproduction or distribution is expressly prohibited.

All other use, copying or reproduction of the Website, the Content or any part of it is prohibited, except to the extent permitted by law.

You must not do any act that we would deem to be inappropriate, is unlawful or is prohibited by any laws applicable to theWebsite including but not limited to:

  •   any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual’s consent) or any other of the legal rights of individuals;
  •   using the Website to defame or libel us, our employees or other individuals;
  •   uploading files that contain viruses that may cause damage to our property or the property of other individuals;
  •   posting or transmitting to the Website any non-authorised material including, but not limited to, material that is, in our opinion, likely to cause annoyance, or which is defamatory, racist, obscene, threatening, pornographic or otherwise or which is detrimental to or in violation of our systems or a third party’s systems or network security.
  •   Purposefully overload the Website by entering extreme amounts of data or using the Website with an extreme frequency other than by hand or by a software robot, with the intent of negatively affecting the performance of the Website to other users.

If we allow you to post any information to the Website we have the right to take down this information at our sole discretion and without notice and restrict your use of the Website  or terminate your use of the Website without notice.

To the maximum extent permitted by law, including the Australian Consumer Law, we make no warranties or representations about the Website or the Content, including but not limited to warranties or representations that they will be complete, accurate or up-to-date, that access will be uninterrupted or error-free or free from viruses, or that the Website will be secure.

We reserve the right to restrict, suspend or terminate without notice your access to the Website, any content, or any feature of the Website at any time without notice and we will not be responsible for any consequential loss, cost, damage or liability that may arise as a result.

  • Services are available on an “as is” and “as available” basis
  • There is no warranty of operation without errors
  • The user bears sole risk for use of the Website as a user
  • We cannot be held liable for specific types of damages
  • Specific hazards like malware and cyber threats may impact the system

12. Liability

To the maximum extent permitted by law, including the Australian Consumer Law, in no event shall we be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your use of the Website and/or the information or materials contained on it, or as a result of the inaccessibility of the Website and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.

There is a maximum amount of liability to which we can be held, which is limited to the value of the payment the Website receives from the user for the services that they use.

13.  Updates

At some point we may wish to update the Website either to provide new features or cater for changes to the underlying operating system platform (platform).

We will endeavor, but not promise, that we will always update the Website so that it is relevant to you and/or works as you expect.

Any changes will be effective immediately upon posting such modified Terms on the Website. It is your responsibility to review the Terms each time you use the Website or place any order for any Products. Your continued use of the Website following the posting of changes constitutes your acceptance of such changes.

14. Jurisdiction and governing law

Your use of the Website and the Terms are governed by the law of New South Wales and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in New South Wales.
